1. Agreement to Terms

By downloading, installing, or using Photo Swipe - Cleaner ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Photo Swipe - Cleaner is a mobile application that allows you to review, organize, and delete photos and videos from your device's photo library. The App operates entirely on your device and does not upload or transmit your photos to external servers.

3. Subscription Service

Photo Swipe - Cleaner offers auto-renewable subscriptions:

• Monthly Subscription: Provides unlimited access to all features. Automatically renews every month unless cancelled.
• Yearly Subscription: Provides unlimited access to all features. Automatically renews every year unless cancelled.

Subscription Details:

• Subscriptions are managed through your Apple ID account
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription

4. Free Tier

Photo Swipe - Cleaner provides a free tier that allows you to delete up to 10 photos or videos. After reaching this limit, a subscription is required to continue using the deletion feature.

5. User Responsibilities

You are responsible for:

• Maintaining the security of your device and Apple ID
• Backing up your photos before deletion
• Ensuring you have proper authorization to delete photos from the device
• Using the App in compliance with all applicable laws and regulations

6. Photo Deletion

Important: When you delete photos using Photo Swipe - Cleaner:

• Photos are moved to the "Recently Deleted" album on your device
• Photos remain in "Recently Deleted" for 30 days before permanent deletion
• You can recover photos from "Recently Deleted" within 30 days
• After 30 days, photos are permanently deleted and cannot be recovered
• We are not responsible for any data loss resulting from photo deletion

7. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs your use of the App, to understand our practices.

8. Intellectual Property

The App, including all content, features, and functionality, is owned by Photo Swipe - Cleaner and is protected by international copyright, trademark, and other intellectual property laws.

9. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove any copyright or other proprietary notices from the App
• Use the App to delete photos without proper authorization

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTO SWIPE - CLEANER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App is operated, without regard to its conflict of law provisions.

15. Apple-Specific Terms

If you downloaded the App from the Apple App Store:

• You acknowledge that these Terms are between you and Photo Swipe - Cleaner, not Apple
• Apple is not responsible for the App or its content
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App
• Apple is not responsible for addressing any claims relating to the App or your use of the App
